well last year on the 13/6/08 i very nicely brought £149.99 worth of tom tom from halfords never worked the way i thought it should but thought it was just me so just restarted it. Well two weeks ago tried to start it up and it wouldn' t start so left it charging for a day still no luck so restarted it with the little button on the bottom started but kept freezing and having to be restarted ,so contacted tom tom support. They advised using the tom tom home program to remove all the aplications and reinstall them uninstalled all ok but wouldn't reinstall kept comming up no disk space?. Managed to get it restarted but no maps, voices etc. me thinks thats ok i'll just take it back to halfords. halfords won't exchange the unit but they will send it to be repaired ok not a problem. got a phone call the begining of this week the unit starts ok but they will not install the maps or voices :evil: so i told them it was tom tom support that instructed me to uninstall the programs in the first place and on top of that every time i try to use the tom tom home program it freezes my computer even after redownloading it. its now still with halfords and the last two days iv'e phoned them and left messages for them to ring me and tell me what is happening and no phone call. time to visit the store and moan me thinks. :evil: :evil: :evil: i'm not paying to reinstall maps there support told me to remove in the first place.

I have tomtom map once you get this sorted if you need. it is only GB but if you need it (with speed cameras)

Ok, in situations like this you need to consult the,
Sale of Goods Act 1979 (SGA),
the Sale and Supply of Goods to Consumers Regulations 2002 (SSGCR),
the Supply of Goods and Services Act 1982 (SGSA)
and the Distance Selling Regulations 2000 (DSR).
Though the manufacturers warranty is only a year, you are still able to get some redress as the sales of goods act protects you for up to 6 years in the UK and 5 in Scotland.
The problem is either, Not many retailers know the law for the above regulations or they just try to ignore it in the hope the consumer will give up.
After a certain amount of time, usually within 6 months after purchase, the burden is on the retailer to prove whether the product is fit for purpose and also whether it was inherently faulty. After that it shifts into the consumers area. If a fault arises within six months of purchase it will be presumed to have existed at the time of delivery.
Now this is where the internet comes into it's own. Go on-line and look for forums relating to the model of Tom Tom you have( best to try and see if tom tom have a forum on their own website) and see how many complaints there are. This is vital evidence for you to argue your case so take a print out with proof of web address to the retailer (Halfords) and ask them to either refund because you feel the goods are not fit for purpose or send it for repair because this model has an inherent fault.
You have rights under consumer law and any products sold are sold either 'As described' or 'Fit for Purpose'. This effectively means that it should be able to do a task it's described as being able to do.
Halfords may argue against it and say you will have to return it to the manufacturer for repair. Don't accept that as an excuse as the point of sale was with the retailer (Halfords) and NOT the manufacturer (Tom Tom). You bought the product from Halfords and they accepted your money. This is called a contract of sale. It's legally binding and cannot be waved off be any retailer that takes your money for a product sold to you.
If you are waiting for a repair or replacement then there is what's considered a reasonable time. You as a consumer shouldn't have to suffer a significant inconvenience while goods are being repaired. The length of time is open to discussion as to what's considered reasonable. You couldn't expect a TV to be repaired in the same amount of time as a digital watch. It depends on the product and what it was designed to do.
If the product can't be repaired or replaced you are entitled to a refund but it may only be a part refund. This is because a retailer may argue you have had reasonable use of the product for a certain amount of time.
As for them no reinstalling the maps, i would speak to Tom Tom again and see if they will send the relevant software for your unit on a compassionate basis. Explain the issue you had and the advice given to you by one of their representatives and also explain what Halfords say their position is.
Make sure that any correspondence you send to either Halfords or Tom Tom which is done in writing is sent via recorded delivery and keep a copy of any letters you send.

Windows NT File System its a more compressed drive structure windows used to be FAT or FAT32 but you couldn't save Large files ie: movies and stuff but with NTFS you can because it compresses the drive and its files to managable sizes which is good for fast access and indexing

It was a glitch that Windows automatically made the FAT32 partition on the older Tomtom NTFS when you did an update from the web, leaving the whole Tomtom dead as its firmware used FAT32.

There were workarounds to update either firmware or teach winodows to behave and retrive the drive.

These Tomtom's were the 1 series and only a year or so old.

Seeing as its well under guarantee I think they should replace it for you, as every thing like what you have brought comes with a year's guarantee,If you do go back to the store just mention 'Trade & Standards' to them, because I don't think, that seeing as there is a problem with the item they sold you, i.e its not allowing you to do what ' it says on the tin'so to speak, I think your well in your rights to have 1. your money back, or a replacement seeing as you have 4 months left on your guarantee...Your Rights
When you purchase something in a shop, by post, phone, or online, you get certain basic rights. If you buy an item that's faulty, that's covered by the Sale of Goods Act. That's the baseline and anything a guarantee offers comes on top of those rights (which is what the phrase "this does not affect your statutory rights" means with a guarantee). Even after the guarantee period expires, those rights will still apply, although you should be aware of their various limitations under the Act.

The Limits of a Guarantee
Sometimes though, guarantees come with conditions attached to them and if you don't keep to them, that could invalidate your guarantee. Let's say, by way of example, that a manufacturer tells you that your new car should be serviced at specific intervals. If you don't do that and the car breaks down, then they might not have to fix it for free. However, even invalidating a guarantee doesn't alter your Sale of Goods Act rights; those remain rock solid.

well halfrauds phoned they have restarted and installed all the components but are unable to install the maps apparently i need to take that up with tom tom themselves. theres that much going on in my life at the mo i just haven't got the time or energy to sort it so krusher if that offer of the maps is still on we,ll have to sort something out.

tell them that you bought it from them the contract is with them and you have been fair in letting them try to fix it

so under the sale of goods act it is not fit for purpose so you are rejecting it and want a full refund or a new working replacement :drink:

I agree with Smiffy. Even though Tom Tom' tech support advised you to clear the applications and such, your contract is till with Halfords and as such should honour the agreements of that contract.
Again, if a retailer accepts your money and subsequently takes it, then at that point it has entered into a contract with the customer. If the problem has existed pretty much from the day the product was purchased then it is up to the retailer to prove the fault is not inherent. Best thing to do would be to refuse the sat nav from Halfords until the unit is back up and running the way it should be. If you paid with a credit or debit card then advise the customer services rep that you will be seeking recompense with your card company in order to secure a full refund unless the issue with the maps is rectified. That should sort them out and they will probably, as a gesture of good will, reinstall the maps and then you will have a fully working sat nav again.

all great advice but i've already picked the tom tom up. and things are that messy at the mo just split withe the wife so lots to sort out i just haven't got the time or energy to argue.

Your not the only one to have problems with Tom Tom!! My 710 just decided to pack up! no longer turns on or charges....

Gonna open it up tomorrow and just see if i can hard wire a power cable into it! As far as i can find out, it seems to be a common problem with the contact points :D

I myself have had a good few problems with the old sat nav devices. The same one being mentioned in the ops post i got mine from argos and after reading up on it took it back to the shop. I advised the sales assistant that i had been on the phone with tom tom for an hour to get the problem sorted with no luck and was instructed to return it back to the store. After babbling him with terms like firmware and fat32 he just swapped the unit there and then. not bad when i had it 3 months.
