Does anybody know the process whereby the decision is made to implement a TRO on a greenlane. I raise the question as myself and Apache Andy went to have a go on a greenlane local to us (we had driven before) but found a TRO had been slapped on it, with a huffing great big sign at the entrance to denote no cars/bikes allowed.

The notice is valid from 22nd jan to July 2008 I believe and the reason stated was that motorised vehicles may scare non motorised users, (horses and people I presume). I have no problems with TRO's as long as they are applied for a legitimate reason, but it doesn't seem so in this case. Furthermore, this is the same lane that I got abuse off from a walker, who I suspect to be a member of the local council and lives in a house oppersite the entrance to the lane. Putting 2 and 2, (reason for closure and the walker) together it seems that there were other forces at work here than the reasons stated on the TRO (which frankly seem a poor excuse, considering it is a 'road'). My question is, is there anyway to appeal it, and has it been done/closed legally? Trugga, can you advise?

have you tried asking your local council for their reasoning behind the desision

As Carl said get in touch with the local council Rights Of Way Officer (ROW).
They can tell you the reason the TRO has been imposed, or even if there is one.
It is not unheard of that residends or tree huggers put there own unoffial signs up.
If you have the exact GR I can try and check the lane.

Can you give me the Ordnance Survey map reference for each end of the lane and if possible, the two letter grid square.

With that information, I'll look it up on Wayfinder and in the relevent section of the GLASS website.

I've found this so far, dated Sun 7 January 2007:

"Emergency Closure TRO placed on this lane by Warks CC on 5th Jan 2007 to last for 21 days to close the lane to all traffic with the exception of pedestrians, because of likelihood of danger to the public and to prevent serious damage to the surface of the road."

On the 6th Feb, this was added:

"This has now been extended for 18months until July 2008"

I can't see any other reason given other than stated above.

So, reading into the above, I would think that the surface of the road has deteriorated to a point where passed by motorised vehicle could not only damage the lane but possible cause a vehicle to loose control and perhaps injure pedestrians or other users - that is what is suggested by the initial emergency TRO.

Where the extension for 18 months comes from I'm not sure - best bet it to contact the ROW officer at the local county council office.

Please, let us know your findings if you do contact them.
